Zield, LLC, a Utah limited liability company (“Zield,” “we,” “us,” or “our”) respects the privacy of individuals and organizations that visit our website, communicate with us, submit compute requirements or capacity opportunities, or otherwise interact with Zield.
This Privacy Policy describes how we collect, use, disclose, retain, and protect information in connection with our website, services, business development activities, and other interactions with Zield.
By using our website or providing information to Zield, you acknowledge the practices described in this Privacy Policy.
1. Scope
This Privacy Policy applies to information collected through Zield.com and other websites operated by Zield that link to this Privacy Policy, as well as information provided to us in connection with compute requirements, capacity submissions, business inquiries, potential transactions, partnerships, development opportunities, and related business activities.
This Privacy Policy does not govern information processed pursuant to a separate written agreement where that agreement contains different or additional privacy or confidentiality terms.
2. Information We Collect
Depending on how you interact with Zield, we may collect the following categories of information.
Contact and Professional Information
We may collect your name, company, title or role, business email address, telephone number, business address, and other professional or contact information.
Compute Requirement Information
If you submit a compute requirement, we may collect information concerning requested accelerator or compute architecture, quantity, workload, geography, networking or topology requirements, deployment dates, contract term, security or compliance requirements, budget or target economics, technical requirements, and other information you elect to provide.
Capacity and Infrastructure Information
If you submit capacity, we may collect information concerning accelerator or architecture type, accelerator quantity, IT capacity, power capacity, geography, facility or site, ready-to-compute date, capacity status, contract terms, pricing or economics, minimum commitments, divisibility, commercial availability, authority to market or place capacity, availability basis, networking or topology, cooling, power status, security or compliance characteristics, technical specifications, and other commercial or infrastructure information.
Transaction and Business Information
We may collect information relating to prospective or actual transactions, counterparties, commercial terms, pricing, availability, diligence, contracts, development opportunities, financing, infrastructure, project schedules, and business relationships.
Communications
We collect information you provide when you communicate with us by email, telephone, forms, meetings, correspondence, or other means.

evaluate technical, commercial, operational, financial, security, and infrastructure considerations;
conduct diligence regarding prospective opportunities and counterparties;
communicate with potential providers, customers, developers, operators, financiers, vendors, advisers, and other relevant counterparties;
negotiate, structure, document, administer, or perform potential transactions and business relationships;
operate, maintain, secure, analyze, and improve our website and services;
develop and improve Zield’s internal systems, processes, models, datasets, analytics, and market intelligence;
detect, investigate, and prevent fraud, misuse, security incidents, unlawful activity, and violations of our terms or agreements;

Zield recognizes that compute requirements and capacity submissions may contain commercially sensitive information.
We use such information for legitimate business purposes related to evaluating, developing, structuring, sourcing, placing, financing, accelerating, or facilitating potential compute and infrastructure opportunities.
Submission through the website alone does not create a contractual confidentiality obligation, fiduciary relationship, agency relationship, exclusivity arrangement, or other special legal relationship between you and Zield.
If information requires specific confidentiality protections, the parties should enter into an appropriate written confidentiality or nondisclosure agreement.
Zield nevertheless intends to handle nonpublic business information responsibly and to limit disclosure to circumstances reasonably related to legitimate business purposes, potential transactions, service providers, professional advisers, legal obligations, or as otherwise authorized.
Do not submit trade secrets, export-controlled technical data, classified information, passwords, private cryptographic keys, highly sensitive security credentials, or other information requiring special handling unless Zield has expressly agreed in writing to receive such information.

We may disclose relevant information to potential compute providers, capacity providers, infrastructure owners, data center operators, developers, customers, purchasers, suppliers, cloud providers, hardware providers, utilities, engineering or construction firms, financing sources, investors, insurers, and other parties that may participate in evaluating or executing an opportunity.
Where practical and appropriate, Zield may limit the information initially disclosed or use aggregated, anonymized, redacted, or non-identifying information during preliminary discussions.
Service Providers
We may provide information to vendors and service providers that support hosting, forms, email, communications, analytics, cybersecurity, information technology, customer relationship management, document management, professional services, and other business operations.
Professional Advisers

Zield also does not currently use personal information for cross-context behavioral advertising.

The commercial placement, sourcing, development, or facilitation of compute or infrastructure opportunities does not constitute a sale of personal information merely because business contact or transaction information is communicated to prospective counterparties for legitimate business purposes.

Zield and its service providers may use cookies and similar technologies necessary to operate, secure, understand, and improve the website.

Zield does not currently sell personal information or share personal information for cross-context behavioral advertising as those terms are defined under the CCPA.
If Zield becomes subject to additional CCPA requirements as its business evolves, this notice will be updated accordingly.

Zield’s website and services are intended for businesses and professionals and are not directed to children.
